Terms of Service

Damark Farm Manager provides tools for poultry farm operations, including but not limited to:

• Bird and batch tracking
• Egg production recording
• Feed and inventory management
• Sales, expenses and profitability reporting
• Worker attendance tracking
• Dashboards, analytics and exportable reports

Features and availability may vary by subscription plan. We may add, modify or remove features at any time.

You must provide accurate and complete information when registering. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorised use or security breach.

Some parts of the Service require a paid subscription. We offer a 14-day free trial for eligible plans unless stated otherwise. When the trial ends, you must choose and pay for a subscription to continue using paid features.

Subscription fees are billed in advance and are non-refundable except where required by law. You may cancel your subscription at any time; cancellation takes effect at the end of the current billing period. Detailed billing and cancellation terms are provided at checkout or in your account settings.

You agree not to:

• Use the Service for any illegal, fraudulent or unauthorised purpose.
• Interfere with or disrupt the Service, servers or networks.
• Attempt to gain unauthorised access to another user’s account or data.
• Upload malware, viruses or any harmful code.
• Reverse-engineer, decompile or extract source code except as permitted by law.
• Use the Service in a way that violates applicable laws or the rights of others.

We may suspend or terminate accounts that violate these rules.

You retain ownership of all farm and business data you enter into the Service. We do not claim ownership over your content. We will treat your data as confidential and use it only as described in our Privacy Policy and these Terms to operate and improve the Service.

You are responsible for ensuring you have the right to submit any data you enter, including personal data of employees or partners.

Damark Farm Manager and its licensors own all rights, title and interest in the Service, including software, trademarks, logos, designs and documentation. These Terms grant you a limited, non-exclusive, non-transferable licence to use the Service for your internal farm management purposes during your subscription.

The Service is provided “as is” and “as available” without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose or non-infringement. We do not warrant that the Service will be uninterrupted, error-free or completely secure.

Farm management decisions are your responsibility. Reports, analytics and recommendations generated by the Service are for informational purposes only and do not replace professional agricultural, veterinary, financial or legal advice.

To the maximum extent permitted by law, Damark Farm Manager and its affiliates, officers, employees and agents shall not be liable for any indirect, incidental, special, consequential or punitive damages, including lost profits, lost data or business interruption, arising out of or related to your use of the Service.

Our total liability for any claim arising under these Terms shall not exceed the amount you paid to us for the Service during the twelve (12) months immediately preceding the claim, or one hundred euros (€100) if no payment was made.

You agree to indemnify and hold harmless Damark Farm Manager and its affiliates, officers, employees and agents from any claims, damages, liabilities, costs or expenses arising from your use of the Service, your data, or your violation of these Terms.

You may stop using the Service and delete your account at any time. We may suspend or terminate your access if you breach these Terms, fail to pay fees when due, or if required by law. Upon termination, your right to use the Service ceases immediately.

Sections that by their nature should survive termination, including intellectual property, disclaimers, limitation of liability and indemnification, will survive.

These Terms are governed by the laws of the Federal Republic of Germany, without regard to conflict-of-laws principles. For users outside Germany, mandatory consumer protection or other laws of your country of residence may also apply where they cannot be excluded by contract.

Any dispute arising from these Terms or the Service shall first be addressed through good-faith negotiation. If negotiation fails, the dispute shall be submitted to the competent courts in Germany, unless mandatory local law requires otherwise.

We may update these Terms from time to time. We will notify you of material changes by email or through the Service at least 30 days before they take effect. Continued use of the Service after the effective date means you accept the updated Terms.
